DMCA/Copyright Policy

PERMANENTUPLOAD (“PERMANENT-UPLOAD”) RESPECTS THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS AND EXPECTS ITS USERS TO DO THE SAME. PERMANENT-UPLOAD.NETLIFY.APP QUALIFIES AS A “SERVICE PROVIDER” WITHIN THE MEANING OF 17 USC § 512(K)(1)OF THE DIGITAL MILLENNIUM COPYRIGHT ACT (“DMCA”) AND IS THEREFORE ENTITLED TO CERTAIN “SAFE HARBOUR” PROTECTIONS AGAINST COPYRIGHT INFRINGEMENT ALLEGATIONS AS SET OUT THEREIN. THIS DMCA POLICY SETS OUT OUR ADHERENCE WITH THE DMCA, A COPY OF WHICH CAN BE FOUND ON THE U.S. COPYRIGHT OFFICE’S WEBSITE AT WWW.COPYRIGHT.GOV. THIS POLICY SHALL BE READ IN ACCORDANCE WITH PERMANENTUPLOAD’S PRIVACY POLICY, TERMS AND CONDITIONS, AND AUTHORIZED REMOVAL AGENT POLICY.
PERMANENTUPLOAD WILL RESPOND CLAIMS ALLEGING COPYRIGHT INFRINGEMENT USING PERMANENT-UPLOAD’S SERVICES EFFICIENTLY AND PROMPTLY WHEN SUCH CLAIMS ARE REPORTED TO PERMANENT-UPLOAD’S DESIGNATED COPYRIGHT AGENT IDENTIFIED BELOW OR SUBMITTED VIA A DMCA NOTIFICATION TICKET CONTAINING THE INFORMATION AS SET OUT BELOW. CONTENT REMOVAL PURSUANT TO A NOTICE OF ALLEGED INFRINGEMENT MAY BE CHALLENGED THROUGH A COUNTER-NOTIFICATION. ONCE PERMANENT-UPLOAD HAS RECEIVED THE NOTICE OF ALLEGED INFRINGEMENT, PERMANENT-UPLOAD WILL TAKE WHATEVER ACTION IN ITS SOLE DISCRETION IT DEEMS APPROPRIATE INCLUDING, BUT NOT LIMITED TO, REMOVAL OF THE ALLEGEDLY INFRINGING CONTENT.

Notice of Alleged Infringement

Alleged copyright infringements occurring on or through PermanentUpload shall be reported by the copyright owner, someone authorized to act on behalf of one, or authorized to act under any exclusive right under copyright by filling out a DMCA Notice of Alleged Infringement and sending it to PermanentUpload's designated copyright agent's email address.

Identify Copyrighted Work – Identify the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by this Notice you may provide a representative list of the copyrighted works that you claim have been infringed.

Identify Copyright Infringement – Identify the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled, including at a minimum, if applicable, the URL of the link shown on PermanentUpload or the exact location where such material may be found.

Contact Information – Provide your name, company affiliation (if applicable), mailing address, telephone number, and email address.

Required Language – Include both of the following statements in the body of the Notice:

“I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).” “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of, the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”

Signature – Provide your full legal name and your electronic or physical signature.


NOTE: Sending a DMCA request does not guarantee complete removal, as the files are stored on the IPFS, however we will try our best to limit access to it and remove it.
